The honest answer is that LLC formation time depends on the state, the filing method, and whether you are using standard or expedited service. Some states tell you exactly what expedite gets you. Some do not publish a clean standard timeline at all. So if you are looking for one universal answer, there is not one. The practical answer is to look at the state you are filing in and whether you are filing online, by mail, or with an extra expedite fee.

Texas: clear if you pay for speed

Texas is one of the easier states to explain because the Secretary of State publishes tiered expedited business filings. Standard expedited service costs $50 extra and filings are typically processed within 2 to 3 business days. Next-day service costs $500 extra, and same-day service costs $750 extra if the filing is received by noon.

The state also strongly encourages electronic filing through SOSDirect or SOSUpload to help with swift processing. What Texas does not clearly publish on that page is one single regular-processing estimate for every non-expedited filing. So the honest answer for Texas is: expedite has a published window, standard filing depends more on current workload.

New York: fast filing acknowledgement, slower full compliance

New York says online filing is available for LLC Articles of Organization and that within minutes of filing, you receive an email filing acknowledgement with the filing receipt attached in PDF format. That is good for immediate proof that the filing landed.

But New York also reminds you that forming the LLC is not the whole story. Members must adopt a written operating agreement before, at the time of, or within 90 days after filing. And most LLCs must complete the publication requirement by publishing in two newspapers for six consecutive weeks and filing the Certificate of Publication within 120 days.

California: current workload matters

That means the paper timeline is the clearest official number here. If you are trying to move faster, online filing is the obvious better route.

The IRS says to register your legal entity with the state before applying for an EIN.
